A Southern Humboldt medical marijuana patient says federal agents raided his home and medical garden despite being within county guidelines.
KMUD news interviewed the man whose property was raided early Wednesday morning. He didn’t give his name but said he owns part of the 2,000 acres targeted in “Operation Southern Sweep.” He believes his 36 marijuana plants were destroyed despite having proper medical marijuana paperwork.
The man was taken to a command post and questioned before being released. He said agents asked if he profits from marijuana, whether he has a job, and what his neighbors do for a living. Agents told him he could not return to his property until Saturday.
“It’s legal now, I went and got my medical and did everything I was supposed to,” he said. “Be aware — the federal government doesn’t honor anything. They’re going to do whatever they want when it really comes down to it.”
KMUD questioned FBI agent Joseph Schadler about busting 215 gardens.
“Simply because they may have a 215 up doesn’t mean its’ still not illegal under federal law,” Schadler said. “For example, If they are part of this larger group [targeted by the investigation], and they are growing marijuana for non-medical purposes, which is outside the statute — even if they say they’re growing it under 215 — it still doesn’t negate the fact that it’s illegal under federal law. Just because we’re not targeting 215 doesn’t mean that somebody can hide behind that when they’re part of a larger investigation.”
The “investigation is about finding truth,” Schadler said, and added that people not involved in the alleged organization won’t be prosecuted. “Our targets are not people simply growing for medical purposes,” he said.

Someone should go after Meth, Heroin and Cocaine but that is just too much trouble. Who is bringing in those drugs or manufacturing Meth in Humboldt?? If you could get a job without drug testing you could work if smoking Pot but probably not if on Meth, Heroin or Cocaine. Crips have been arrested here for drug sales and have been recruiting young people to “join” their gang. We have had some of our teens incarcerated for killing someone – that is what the Crips require to join.
Drug arrests in various cities for many years for Heroin and Cocaine have been tracked back to various L.A. gangs. So why don’t they bust them? The gangs there are well armed and it would not be easy. In Humboldt it might be easy to determine who is selling except for Proposition 36 where all the Meth manufacturers and sellers of other drugs get sent to drug court and come out of the Courthouse laughing about how they did not get any jail time. Check into how many people even complete drug court and you will find out why we have the drug problem we have.
The serious drug manufacturers and drug dealers also do not report income taxes and make millions of dollars and also use kids that can be smart enough to sell their drugs – 8 years old and up that will stand on street corners and sell the drugs and sell them in the schools. The “big” manufacturers also prefer children that are under 18 so they won’t do big time but get sent to correctional facilities to sell the meth, heroin and cocaine. A couple of years ago there were newspaper articles about a couple of reporters that posed as homeless people but they saw drug deals going on and reported on that.
IRS wants their money so they trek around and search properties even if they have 215 approval. As I said before Federal Gov does not recognize 215 cards and marijuana growing is all illegal and most have not reported the “sales” on their income tax (which should include the meth, heroin and cocaine sales too). How many years will some of these people serve if and when they are finally arrested by the Feds and IRS – could be a lot.

OK can I say here that “I went and got my medical” sounds pretty sleazy to an actual patient. Try not to say this if they come to your house. These are not free passes to criminal behavior issued for 200$ a pop. When you use the system this way you are eroding the life support system for the patients (and doctors) who desperately need this plant for treatment. What this means is that the patients are continually the ones on the battlefield of this war on drugs…and they die from it.
Thugs have been preying on the legitimate patients here for some time now. The system is currently set up to favor this since there are really no coherent dispensary systems in place. All of these hot spin (propaganda) issues are related to the fact also that because of the potential thuggery people who need the plant for legitimate 215 purposes are often drawn into grows with people who are setting them up, using their housing, not protecting private property, and essentially strip mining our community for its good will and good seeds. The worst part is I believe that this is just the start of a much larger operation. All the attention that Humboldt has had in the media ect. has brought down the big dogs. These warrants have little to do with 215 and everything to do with trafficing and tax evasion. The general public sees that harm is caused by people who use 215 to justify antisocial behavior, and we don’t like it.
Most people who voted for 215 didn’t intend to allow “medical” marijuana to be sold on the black market or to “patients” at black market prices. Of course they were naive, but thats how it was.
Some people voted for 215 believing it was theraputic and a step to complete legalization. They believed that 215 would demonstrate that marijuana use can be benign or beneficial to society. In that way, it would overcome the stigma of illegitmacy. These people favor limited collective or co-op grows and support close medical management, auditable record keeping, tax collection, and tight limits on where and how big gardens can be. They too were naive, but thats how it was.

One big problem with medical marijuana laws is that it is very difficult for lots of legitimate medical marijuana patients to get a prescription (recommendation.) This is because most doctors simply don’t give them out even if they are sympathetic because they fear the DEA. We have to seek out a “pot doc” and pay the extra $ to get our recommendation. Why shouldn’t our own doctors do this for us?
Although a “limited collective or co-op” model is attractive it can’t happen in a climate of Federal intimidation, fear and hate mongering. Complete legalization is the way to correct the abuses.

Remember, it is medical, so a doctor, not you, is the person who decides what medication is indicated.
If your doctor believes you have a condition that can be helped by marijuana, she can completely legally prescribe you marinol. If you respond to that treatment, you’d likely be able to convince her to issue a marijuana prescription.
The truth is that many people just like getting high(and party with their friends) and want a “pass” to grow or get it at a store. Thats not 215, thats legalization and it hasn’t happened. If you argue that’s not true, you’re either lying or in denial.

You are the one in denial, brave anonymous one. Most doctors simply refuse to issue ANY recommendations for any reason. This short circuits any arguments you may make from the doctors point of view.

YEAR. Combine that with a healthy fear of the DEA and an abysmal ignorance of current pharmacological research and no recommendations are written.

code enforcement task force meeting tomorrow!
the code enforcement task force meets tomorrow (friday, june 27th) at the board of supervisors chambers at the county courthouse in eureka. (does anyone know the time of the meeting, or the agenda, or what time the public comment period starts?)
with all the heavy-handed fed raids in the last few days, its important that we don’t lose sight of this code enforcement issue. we may not have much influence over the feds, but we sure as hell should be able to influence our own county government!
this task force meeting is a great opportunity to tell them what we think about the revelations at the last task force meeting that the county “lost” all the documents pertaining to the formation of the code enforcement unit, due to a “flood” in the county courthouse basement.
and since they were forced to add a “public comment” period to the end of the task force meetings, you can speak to them if you like. but even being another “warm body” there lets them know that we haven’t forgot about this.
and the moratorium on non-consensual code enforcement inspections, using their magical no-probable cause “inspection warrants” ends in a few weeks.
we need to demand that, at the very least, the board of supervisors must extend the moratorium until after the task force has completed their work. they haven’t even got to the bottom of what went wrong yet, much less worked out what should be done in the future!
and we should also express our desire that the county should drop its shameful lawsuit against the yee-haw ranch in trinidad, site of one of the most egregious code raids that took place.
shortly after residents there complained on KMUD about how they were treated by desadier, fulton, and the rest of the code raiders (including having a gun pointed at an unarmed woman with two young children for no good reason) the county decided to file a lawsuit against charles garth, the owner of the property, and even against his tenants – for “conspiracy” to commit “unfair business practices” for the terrible crime of exchanging “substandard rent” for modest accomodations.
this retaliatory lawsuit has already rendered individuals and families homeless, and amounts to adding insult to injury. and if it goes forward, it’s likely to cost the county big bucks for outside counsel (just like the pepper spray case and the tooby lawsuit) because the county counsel has such a clear conflict of interest, as they were one of several agencies that were kinda-sorta supervising the code raiders.
wood ranch and elk ridge have been on the agenda of the task force, but apparently not yee-haw. if they continue to try to dodge the issue tomorrow, then we certainly have the public comment period at the end of the meeting to let them know how we feel about this!
as others have pointed out, if the county clowns can’t even prevent important county documents from being destroyed in a flood in their own basement, they’ve got a lot of nerve telling the rest of us how to live!
i don’t have the exact time, but it’s something like 10 a.m. – ?
does anyone know the exact time of the meeting, and/or the agenda?

it’s not on the c.l.m.p. web page – and i’m not criticizing them, they must have their hands full with the invasion by the feds.
but it’s important that we don’t let one level of opression (the feds) prevent us from keeping our eye on the ball with another level of oppression (the county code cops).

i realize this message is kind of “off-topic,” so if you want to post this message on the front page as a “guest opinion,” feel free. or if you’d rather skip my opinions and just post a reminder about tomorrow’s meeting and maybe link to your last post about the “purge”/flood of county documents. if you happen to know the time of the meeting and can add that, that would be even better. i know i’m posting this request pretty last-minute, and i know there’s a whole lot else going on at the moment so i certainly understand if you don’t have time. still it would be a great service if you could at least put a quick reminder about tomorrow’s meeting up on the front page… – thorn

State Rights Issues versus Federal Government = Civil War issue
U.S. Constitution = America’s guidance for the most part. Are states not part of America? If the State Constitution is to adhere and conform to the U.S. Constitution, then what is not in conformance regarding the 215 issue/U.S. Constitution?
Simply it seems again and again, this 50 year plus war on drugs is proving to be a social failure in every way except for: making govt. undocumentable money; allowing the bigtime criminals to profiteer money by mega-super inflation; endorsing big pharma the “shenanigan rights” to market chemicals extracted from a plant that does not need extraction – inventing processes unnecessary; perpetuating sortie missions on private property by govt. officials; increasing the debate of “Civil Rights” in the fight for defending one’s property while bearing arms…..
This 50 year plus war in America is a total failure in more than one way. However, it does give good historical vantages to deduce what will happen in Iraq. Uber Money profiteering. Ouch!
So, why would a govt. not want to allow what the people vote for? Why would the most appropriate, yet subtle change in policy, be so common sensible to rationalize, but so hard to materialize? Why would the correct decision be denied by the Feds? Sometimes, power and control is worth more than sales tax generation, business tax generation, industry advancements, people’s rights, etc…Shameful politics.
Every little thing adds up to a big thing – cumulatively. So, when people’s rights are so vanished that they finally become concerned, the big thing will be the hurdle one jumps to get those rights back. Freedom is worth fighting for.
