Dateline Eureka… The only daily newspaper serving this small logging town of 30,000 remains hanging on life support this morning… still unable to recognize a story or respond to visitors.
Fifty million smackeroos… that’s what Bank of America is suing local boy-done-good Rob Arkley for… The Eureka Times-Standard has still not noticed. Doctors have tried smelling salts, but the mighty press juggernaut remains prone. Relatives say the press giant can still respond to press releases, but doctors say that such responses often fool laypersons, making papers in a vegetative state appear to have consciousness.

Just a guess, but my guess is that in their settlement of the lawsuit against the Reporter, the Times Standard agreed to certain “prior restraints” under which they agree to not report anything unflattering about Rob and his various companies. If so, I wonder for how long? Life?
C’mon Heraldo, you can’t expect the Times Standard to cover every little misunderstanding between men with white collars. What possible difference could it make to those of us with mortgages? This is not real news. No one is bleeding, it’s not like theft or a hit and run. Is it?
Hard to tell in cold “print” but “Ed” has got to be attempting sarcasm. The lending and financing behavior at the heart of this suit is VERY much “like theft or a hit and run” ESPECIALLY for “those of us with mortgages” and the whole country actually.
It’ll make the Los ANgeles Times before the T-S. Just like when Butterhead had been in a Redwood Tree for a year. London Times covered it, then LA Times, then finally T-S had to recognize it.

The Times-Standard is an outlet for governmental/corporate propaganda talking-points. Having local stories is a lot like those radio stations in Illinois who pretend to be local by running ads and taking calls from people in the area.
Eventually they realize that they don’t really need journalists to disseminate propaganda. They just need ad revenue to pay for it.

Ed is absolutely right. And it’s nowhere near as critical to our community as Jessicurl’s founder being on Canadian TV. The Times-Standard, poor thing, must triage its stories and handle the most important ones first.
Seriously, you guys should leave the TS alone. We know they don’t waste ink on victimless crimes on paper. And Hoover, forget it, he would NEVER spend valuable copy space on victimless crimes. The real question here is Hank. He probably will be all over this like white on rice. It’s like someone dared him, like someone double dog dared him.
Don’t think Ed was being sarcastic and I agree with him. The suit is an interesting “tidbit” but it doesn’t rise to the level of journalistic news. There are probably hundreds of civil lawsuits going on locally. And many more restraining orders, divorces, and petty neighbor disputes. Unless they involve serious allegations about a public official, I don’t think they’re newsworthy. Tabloidworthy, Gossipworthy and Blogworthy perhaps. The Arcata Eye ran an item ths week about a city council member who was caught renting out a room not qualified to be living space. I’d say thats barely a news item, but also wouldn’t want to see it in the TS.
The key issue here, of course, is that Arkley is the mastermind of the most controversial development plan in Eureka, and still owes the city for the EIR on that project. The T-S reported in January that Arkley is “trying to make monthly payments.”
Trying? Houston, we have a problem.
I love it Heraldo. Keep poking and maybe someone over there will open an eye. Hard to believe they wouldn’t take a chance to report on the owner of the OLD Eureka Reporter. Well, at least you can still get the rainfall totals in the paper, and let’s not forget Garfield. Even Rob’s friends at KINS asked him to comment on the story. Maybe that old beat-up Datsun in front of Rob’s house has a sleeping Times Standard reporter learking inside waiting, hoping the old boy will come out, bang on the window with his big stick, and give the poor young man a scoop.

There’s not an ounce of “investigative reporting” done at the sub-standard. They print what they are told to print….according to one reporter (what’s his name) they only print exclusive stories, no day old news for them and certainly nothing that would hurt their “bottom line”. What puzzles me is why channel 3 won’t do a story if the TS is on it?
When the ER shut down, all the employees at the ER had to sign a form saying they wouldn’t talk badly about the ER or Arkley as terms of receiving severance pay, which I later found out is guaranteed in the event of a mass layoff. So that could be the case.
certainly telling the truth about Arkley can’t be found as “talking badly” about him. The TS is not an employee of Arkley so what is REALLY going on? Certainly not a “free press” or a democratic foundation upon which to run a newspaper that represents what is happening at all important levels of this county. Time for a new approach to the news…one with courage and high principles.

The Federal Deposit Insurance Corp. has issued a cease and desist order to Covington-based Statewide Bank. (owned by Rob Arkley Jr.)
The bank consented to the March 25 (2009) issuance of the order “solely for the purpose of this proceeding and without admitting or denying the alleged charges of unsafe or unsound banking practices and violations of law and/or regulations,” the order says.
“The FDIC and the Louisiana Office of Financial Institutions considered the matter and determined that they had reason to believe that the bank had engaged in unsafe or unsound banking practices and had violated laws and/or regulations,” the order says.
Calls were placed to Statewide for comment.
The order says the bank is to cease and desist from the following:
- Operating the bank with an inadequate level of capital protection for the kind and quality of assets held by the bank.
- Engaging in speculative or hazardous investment practices.
- Operating with an inadequate investment policy

- Operating the bank with an excessive level of adversely classified loans or assets.
- Operating the bank with an excessive level of delinquent and nonaccrual loans.
- Creating concentrations of credit.
- Operating the bank with inadequate written loan policies and procedures.
- Operating the bank with management whose policies and practices are
detrimental to the bank and jeopardize the safety of its deposits.
- Operating the bank in violation of applicable federal and state laws and
regulations.
- Operating the bank without a realistic or comprehensive strategic plan.
- Operating the bank with inadequate earnings to fund growth, support dividend
payments and augment capital.
- Operating the bank without adequate liquidity or proper regard for funds
management in light of the bank’s asset and liability mix.
The bank has locations in Abita Springs, Mandeville, Folsom, Slidell and Covington.

Arkley bank fail(s)
The Federal Deposit Insurance Corporation (FDIC) shut down Rob Arkley’s Statewide Bank today. Despite the bank’s promising logo, the bank was apparently not “on it.” Statewide Bank, Covington, Louisiana, was closed today by the Louisiana Office of Financial Institutions, which appointed the Federal Deposit Insurance Corporation (FDIC) as receiver. To protect the depositors, the FDIC entered into a purchase and assumption agreement with Home Bank, Lafayette, Louisiana, to assume all of the deposits of Statewide Bank…
The FDIC estimates that the cost to the Deposit Insurance Fund (DIF) will be $38.1 million. Home Bank’s acquisition of all the deposits was the “least costly” resolution for the FDIC’s DIF compared to all alternatives. Statewide Bank is the 30th FDIC-insured institution to fail in the nation this year, and the first in Louisiana.
Arkley Jr. purchased the bank in 2003. Statewide Bank, a community bank, began in 1926.

Gee, this is one of those “are you smarter than a 5th Grader” questions. First of all, we don’t live on our own planet. What people are doing on earth is up for discussion. Second, when local people run a business into the ground such that the Federal government steps in and spends millions of OUR dollars, this too is up for discussion. Third, when a local business leader not only fails, but fails on a massive scale AND their misdeeds are itemized by federal regulators, this too is up for discussion. Fourth, when a local business leader fails BIG, the failure potential for one of the many local businesses they own is also up for discussion. Fifth, can the local community trust a failed businessman after a 82 year old financial institution is run into the ground under very questionable business practices? The questions simply write themselves, if one is willing to think critically. Truth Speaker indeed! Whose version of the truth? Rob Jr.?

Heraldo’s daily posts seem to always incorporate Rob who, according to Heraldo, is a bad businessman who does little for the community. If he’s so inconsequential, quit obsessing about him. You said the federal gov’t spent millions on Rob’s bank. That’s incorrect hence his financial difficulties. As far as this specific business failure impacting us, the local community, we’ll have to wait and see. Rob, like most big businessmen, has his assets spread out and his companies are all LLC’s so that when one fails, others, like the local Security National branch, won’t be held liable. Lastly, you said can the local community trust Rob. Why does Rob need to be trusted? He hires people. If you don’t trust him, be a janitor for someone else. If you think he’s a good businessman as I do, try to get a job working for him. In what way does he need the communities “trust”? He’s a private businessman. As long as he’s not conductiing illegal activities, his business is his business and you can kiss his ass if you don’t like it (and kiss my ass too for being a dipshit).

The reason this is of local interest and newsworthy is because Security National employs people locally. Also, Security National owes money to local vendors, individuals and entities, including the City of Eureka. This equates to a legitimate and vested interest in this story and the financial health of Security National.

Bank of America may be in a world of hurt. They are not sending foreclosure notices even if you have not paid your mortgage for a year or more. That would go on their books so they don’t want that. Suing other companies is just status quo. If you could get into other states’ suits you would find plenty of them.
Bank of America took over the Countrywide fiasco that had plenty of millions of dollars of foreclosures and that is BofA’s problem now. Put the foreclosures on your books and they are broke again.
Security National is a separate entity or LLC. Rob owns dozens that are divided so that if one fails, as this one apparently has, others, like Security National, won’t be liable. That is why the failure of this bank won’t cause the failure of Security National.
While on the point of Security National, we agree that its failure would substantially impair our local economy which brings me to my point that Rob is an important part of the community. He’s flawed like everyone else and maybe even more of a dick than most, but the obsession with hating on him seems way over the top. You said it yourself Anonymous, the community has a vested interest in him doing well. I agree so people should stop acting so happy when he does poorly. It goes directly against our best interests as a community.

4:33- you said Rob “owes” local vendors… Rob, by virtue of owning a billion corporation, “pays” local vendors for their services along with the other people you listed. This is why he is so important. The money he owes is nothing compared to the money he has paid and will continue to pay. The problem isn’t that their will be money left on the table, the problem is that if Rob goes under so to will some of the local vendors, hundreds of his employees, and so on. Security National is a key cog in the local economy. The money they circulate along with the tax revenue is what will be sorely missed if Security National was to go under. Even if he’s a giant asshole, he still is good for our depressed local economy. That’s what I wish we could ackowledge and agree upon.
If tss at 4:54 is right then what many of us are saying about capitalism is true, communities are better off at a grass-roots level where high-finance is not a part of building a sustainable future. If we are dependent upon greedy ass-holes for a vibrant economy then I’d rather go back to the days when a merchant can be run out of town for cheating his customers instead of protected because we NEED them!

According to Truth Speaker, Arkley is a local “too big to fail”. I don’t agree. Not that I think this lawsuit is a big deal for SN, but the area has survived the demise of larger entities, e.g. gold mining, timber, and fishing. If and when SN goes poof in the night, life in HumCo will go on.
I’m more concerned about a big earthquake. When that happens, an immediate and large amount of external financial support will be needed to continue an industrial economy here.

I heard the Arkleys were headed to Washington to testify against Goldman Sachs. “It takes one to know one”.
Truth Speaker, Bank of America’s refusal to execute loan documents, without Rob Arkley’s personal wealth as collateral, is a strong indication that the Security National family of companies is struggling for capital and credit. The number of LLCs is irrelevant. Arkley’s agreeing to put his personal wealth on the line is evidence of systemic problems. Business people just do not do that unless it is absolutely critical to the venture.
I agree that Security National’s failure would have financial impacts on our community beyond just the loss of those jobs. It already has. They owe six figures to the City of Eureka. And if SN can no longer afford to pay taxes on all its properties that will have a major negative impact on our schools.
I said earlier that the employees, vendors, individuals, creditors and so forth have a vested interest in the Security National financial situation. As an extension of that, I completely agree that we, as a community, would be better off if SN comes out of this successfully. I hope they do for the sake of all involved – especially those who will be directly impacted (adversely) if not. As others have mentioned, there is also a trickle down element that potentially impacts the community at large. All of this is exactly why the story is of interest for our region – a pretty big deal and one would think newsworthy for our main local “daily.”

Yep, the city cares, among others…like B of A. Lots of people are concerned and want to know where they stand in the line-up, so to speak. That’s why people need to look beyond their satisfaction in seeing Arkley in a tough spot (granted, something we can all appreciate) and hope for a positive outcome – for the sake of others.

Remember, this is not Rob’s first bank failure. The same thing happened to his Nevada bank, I think it was the 5th Street Bank. When the money is flowing, you can get away with border line banking practices. His way of using his money was doomed to fail in a very down economy. You roll the dice, and pay the house. Gambling should have no place in how banking is done.

The sad, sad fact remains. It’s been four days since Heraldo pointed out that Bank of America is suing Eureka’s wealthiest, most controversial citizen, and the largest charitable donor to many Eureka institutions. And the T-S has still not printed word one.
If editors and publishers could be impeached, the Times-Standard would have a new editor and publisher by now.
If the babbling classes of Humboldt were functional, the Times-Standard would never receive another advertisement.
In defense of the T-S, I understand they are working on the story, digging beyond the fact that it’s happening and into what it means. Do you imagine they are getting much assistance from Arkley? Let’s cut them some slack.

So the Times Standard finally broke the story today, apparently Thadeus came back from his vacation.
But his article was well written & informative. It gives us a lot of facts about the history of the interaction between B of A & Arkley.
One telling statement from Eric Forster, a Los Angeles Realty adviser serving as an expert witness in forensic accounting, mortgage banking &lending policies.
“It’s not a particulary interesting story, it’s been happening all over the country to mortgage companies. It’s him & everyone else.”
So no big deal. I encourage all of you not entirely insane to read the story carefully.

I don’t understand why you jump from a realty adviser who has seen many such suits saying “[I]t’s not a particularly interesting story” to the conclusion that it’s “no big deal.”
It’s “no big deal” to Eureka when a billionaire in Omaha is being sued for $50 million. When the billionaire lives in Eureka and, as the story puts it, employs 400 people in this area, it’s a big deal.
Speaking of insane, read some of the comments on the Times Standard website. Also notable is the inability of many to spell (or type?).
By “not particularly interesting” Mitch, I took it to mean that it wasn’t that unusual. No big scandal, no cheating just business.

I would suggest that the newsworthyness of this story is that a man controlling several billion $ worth of other peoples money has found a way to insulate himself from the consequences of his own greedy megalomania through incorporation.
So-called “conservatives” make a lot of racket about personal responsibility, but their own failures in that realm are so typically spectacular and always based on their own human frailties of greed and selfishness and lust for illegitimate power. [NOTE-- I define illegitimate power as power aimed at self- satisfaction/aggrandizement vs unselfish service to others. Seriously, are any of these shell game scammers ever convicted of their fraudulent ripoffs for the purposes of giving their fortunes to the poor and oppressed? These are not "robin hoods"-- they are white-collar hoods and Rob Arkley is one of them!]
While this mode of selfishness elevated to ethical high ground is unquestionably represents the true moral center of our exploitation-based culture, it certainly is not a recipe for long-term sustainability. It more closely resembles the Hobbesian notion of a chaotic war of “all-on-all”.
No culture can thrive and prosper- or even survive- if the people who “inhabit” that culture can find no positive outcome that makes their support and participation worth their energy and effort.
If sociopathic levels of greed and centralization of power are all that the exploitation culture can promise those of us who get up every day and produce something of intrinsic value through our hard work, knowledge and skill, then we will continue to checkout and this diseased system of oligarchy will inevitably fall and those who hastened its collapse should prepare to be looking over their shoulder for the rest of their natural lives because their personal liability will inevitably be reckoned with by an angry and disillusioned mob thrashing out mindlessly in their rage, hurt and disillusionment.

I understand your frustration, but… read the T-S’ story. Notice that the reason BofA is coming after the Arkleys is that they DIDN’T get to protect themselves via incorporation.
What is worrisome is that it is no big deal and that he is just one among many high rollers who are about to see the chickens come home to roost. The estimates of banks that will go under this year, for making risky financial deals with other peoples money, is double what it was last year. That is a big deal and represents billions in bad real estate loans, bundled and sold to the BIG banks at a discount. Behind it all are family homes being foreclosed on at an alarming rate. It is still a growing sink hole and even Rob Arkley’s home here many go on the auction block too, if he can’t come up with the money. And those 500 local jobs are at risk, no matter what he say. So remember “what is happening to Rob is no big deal” only because it is happening to many other sub-prime corporations as well. I always thought bankers were supposed to be smart. Being able to play with other people’s money must be some narcotic.
