The so-called Citizens for a Better Eureka (CBE) saw their case against the California Coastal Commission (CCC) thrown out of Humboldt County Superior Court Wednesday.
After issuing a temporary ruling from the bench Wednesday siding with the CCC, lawyers from the Pacific Legal Foundation (PLF) fought to sway Judge John Feeney that the Balloon Track was outside the jurisdiction of the Commission. The court saw through the legal shenanigans and upheld the CCC’s demurrer, thereby tossing the case out of the court without leave to amend the complaint.
PLF represented CBE in the case, but now they’re SOL.

UPDATE: Wednesday’s smack-down also signals the end of Security National’s lawsuit against the Coastal Commission, but SN lawyers say they will appeal the decision.

Judge Feeney’s ruling validates and confirms the position of Citizens For Real Economic Growth (CREG): that Security National has been stalling the cleanup of the Balloon Track. If that is not the case, I challenge them today to provide the California Coastal Commission with the information needed to hold the next hearing on their suspended Coastal Development Permit. I call on Gary Bird and Leona Simpson (members of Citizens for a Better Eureka), if they are truly serious about getting the Balloon Track cleaned up and developed, to demand that SN comply in good faith with the Coastal Commission process. That process has now been found to be legally valid, beyond question. There is no reason that remains for Security National’s foot-dragging to continue.
How long will SN’s promised appeal delay things?
As spokesman of CREG, I call on Virginia Bass, Eureka mayor and candidate for Fourth District Supervisor, as well as Eureka City Council members Jeff Leonard, Mike Jones and Frank Jager, to publicly prevail on Security National to comply with the legal process now confirmed by Judge Feeney as valid. Without their voices actively demanding that SN provide the simple information requested by the Coastal Commission over seven months ago, they are tacitly assisting Security National with subverting the process of getting this critical parcel cleaned up and developed. I challenge each of these elected public officials to come forward and demand that Security National act quickly and comply in good faith with the legal process they have so far successfully evaded. In the absence of strong public pronouncements on the part of these four elected individuals, it is left to the citizens of Eureka to conclude that they are more serious about protecting a favored local corporation to conduct political games against its perceived adversaries, than they are serious about cleaning up the Balloon Track.

Obviously this is how the judge would rule. They were essentially claiming that the Eureka Police had no jurisdiction in Eureka, because a Neighborhood Watch group had claimed the territory.

Geez, I am inclined to vote against the re-zone in November solely in protest of the Arkley arrogance and manipulation. The development itself- as proposed- I never really had a problem with and still don’t. But now, even if it were to be a manifestation of heaven on earth, I am now opposed to it just because of the “I can do whatever I want and up yours” attitude of the developer. Don’t care about the community- Don’t care about the environment- Don’t care about the law- hey, we don’t care about you either.
There hasn’t been a community around Humboldt Bay for many years…so what does it matter? I’m praying for tsunami, it’s the cleanest way to fix broken Eureka.

Ground zero turned out to have residual toxic problems. cleanup of the Brownfield/Balloon track must not be rushed and be converted to safe standards. All of Humboldt will be patrons–not just Eureka.
