Rather than deal with the controversial firing of Eureka Police Chief Garr Nielsen at its regular meeting next week, the city council is opting for a quieter affair while y’all are at work.

The council will meet at 1:00 Friday afternoon for a closed session on the firing. There will be a chance for public comment if you hear about it in time and have no previous obligations during working hours.

If there is any question whether Eureka City Manager Dave Tyson likes to see his employees undergarments, this story seems to cinch it.

Here’s how the firing of police Chief Garr Nielsen went down:

Tyson arrived at EPD at 11am on Friday for a pre-scheduled meeting with the Chief.  Such meetings were not unusual, but this time Tyson had Asst. City Manager Mike Knight in tow. Once in Garr’s office, Tyson read from a prepared script to inform Garr he was sacked, effective immediately.

Tyson told Garr to hand over his phones, computers, radios, badge, service revolver — and his uniform — on the spot. Garr happened to have an extra set of clothes in the office from days off doing maintenance at the Department (incoming police chiefs take heed — an extra set of clothes will limit the time Tyson gets to gawk at your undies in the event you are fired for no reason).

Tyson gets Garr down to his skivvies and starts asking him about guns.  Does he have any at home?  Garr said no. Tyson asks about Garr’s rifle, and Garr points to it hanging on the wall in his office.

Captain Murl Harpham then walks into the office — apparently already informed of the firing — to escort Garr from the building.

After collecting a few belongings from his police car under Tyson’s watchful eye, Garr walked across the street to his car and left.

Coastal Commission has jurisdiction over Balloon Track

A lawsuit by the so-called “Citizens for a Better Eureka” (CBE) has bombed out in the California 1st District Court of Appeals, which affirmed the lower court’s decision that the California Coastal Commission (CCC) does indeed have jurisdiction over Balloon Track property.

CBE argued the CCC didn’t have authority to hear appeals filed by environmental groups, Humboldt County Planning Commissioner Ralph Faust and two members of the CCC itself over a Coastal Development Permit approved by the City of Eureka in 2009. The higher court disagreed.

“[W]e affirm the judgment denying CBE’s petition for writ of mandate that seeks to prevent the appeal from going forward,” the court wrote in its decision filed Wednesday. Read it here.

The Appeals Court agreed with the Coastal Commission and wrote in its ruling that “the Phase 1 development [of the Marina Center project] ‘goes far beyond just nuisance abatement.’” Phase 1 is designed to prepare the property for a big box mall rather than simply address nuisance issues.

CBE was represented by the Pacific Legal Foundation.  Balloon Track owner Rob Arkley is a past board member of PLF.


Backtracking at EPD underway under interim Police Chief

Temporary Eureka Police Chief Murl Harpham announced on local right-wing talk radio station KINS Wednesday that he was going to do some restructuring at EPD.

We’re “gonna get back to where I think it should be,” he said.

Murl has been acting Chief since Garr Nielsen was fired Friday.

As for future prospects to fill the position, sources say Humboldt County Coroner Dave Parris is at the top of the short list. Parris is old school EPD, with 27 years there before being hired in 2006 as Yurok Tribal Police Chief.

Petition drive to fire Tyson meets Saturday

Eureka City Councilwoman Linda Atkins will meet with residents at noon on Saturday at California and 15th to gather signatures for a petition calling for the removal of David Tyson from the Eureka city managers office.

Atkins first made the announcement at a meeting in support of fired Police Chief Garr Nielsen, and repeated it on KSLG this morning (audio to be posted soon, stay tuned).

The campaign manager who ushered several current elected officials into office in Eureka was busy taking stock of the opposition at Monday’s meeting in support of fired Eureka Police Chief Garr Nielsen.

Matthew Owen, husband of Humboldt County Supervisor Virginia Bass and hero to Eureka Republicans for his political wins didn’t speak at the meeting but took copious notes.

Yet somehow, the few who support the firing complain that Nielsen supporters — rather than Owen’s flock — are politicizing the unpopular move by City Manager Dave Tyson.

Tyson tipped his hand when he sacked the Chief last Friday. Despite ousting Nielsen without cause, Tyson got all dramatic about it and gave Garr “about 5 minutes” to gather a few items, and turn in his uniform before escorting him out of the building.

Councilwoman Linda Atkins, a Nielsen supporter, said Tyson’s big move may have been geared to “demoralize” the community.

She said funds from Measure O, which raised the sales tax in Eureka to pay for police and fire services, will now be used in part to pay the severance package for breaking Garr’s contract without cause. Measure O had support from both sides of the political isle, including Atkins and former Councilman Larry Glass.

Tyson appears to have 4\5 support from the city council in every little thing he does.  He is a friend and supporter of the small contingent of bad actors in the EPD who resented the positive changes brought by Nielsen. Tyson’s role in that despicable chapter in Eureka’s history is preserved in the deposition transcripts that came out of the Tawnie Hansen case, in which a former city employee sued the city and Tyson for harassment and hostile workplace environment.

Free recycling in Arcata again

The Arcata Community Recycling Center’s  CHaRM (Center for Hard to Recycle Materials) accepts a wide variety of discards, both everyday recyclables and those that require special handling.

Beginning July 1, 2011 ACRC is reducing the facility fee for drop off of these materials to zero (the current fee is five dollars per visit).  Certain materials, such as electronic waste, appliances, and fluorescent tubes, will still require a small fee to cover their safe handling.

Drop off recycling of mixed paper (newspaper, magazines, cardboard, and office pack) and containers (glass bottles and jars, aluminum cans and formed containers, steel cans, and #1-#7 plastic bottles and containers) will now be offered as a free service.

The CHaRM is located in Arcata at Tenth and N Streets. The facility is open Tuesday through Saturday, 10:00 a.m. to 5:30 p.m. For questions about recycling please call 445-4321 or visit arcatarecycling.org.
