Firecracker cop faces charges

A Humboldt County Sheriff’s Deputy who severely injured himself and a 10-year old Ferndale girl with a Fourth-of-July firework will face charges from District Attorney Paul Gallegos, reports KMUD news.

Deputy Joe Marsh will face a felony child endangerment complaint based on a CalFire investigation. Conviction could result in 9 years in prison.  Marsh has not been arrested, and will be arraigned on Jan 21, 2011 in Humboldt County Superior Court.

    This story makes me sick on so many levels. Adults endangering children just really gets to me. Where were the parents? My children were always with Robin and I during all “Legal” fireworks. Why? I was once careless with illegal fireworks as a young teen and had a “black cat” go off in my hand as I just released it (In Myrtletown) and it was a message to me that I was lucky to have my fingers. (They were hurting for a time.) I hope this will be a rallying point for others to never do this in the future. That would be the most positive outcome.

    How was Paul part of this post? The Herald is simply stating that Marsh will be charged. Charges come from the DA. Promoting?

    It is unfathomable to me why you belittle PLEA BARGAINS, ANONYMOUS. Otherwise the Officer will spend more time in an already over-crowded prison!

    A PLEA BARGAIN IS DESPICABLE when the police THREATEN, INTIMIDATE, BULLY, AND PSYCHO-SADISTICALLY TORTURE an innocent youth for something s/he definitely did NOT do; or else s/he “would get a much longer sentence in prison,” if s/he justifiably DEMANDED due process of the law by jury trial.

    What do you think the out cry would be if this had been drugs instead of fireworks that had injured the child? Also, being a LEO he should be held to the highest standards. What’s hard to understand is why it took CalFire this long to pass the case on to the DA’s office.

    Hopefully,

    more consideration will be taken by all users of fireworks, legal or not, to keep them darn things to themself. This includes not including others in dangerous and wreckless conducts for whom are neighbors having nothing to do with the fireworks display/show with the exception that it is their property that gets bombarded at times by other peoples’ air flights.

    Good thing roofs are fire-rated today – can you imagine a neighborhood of old style Victorian homes with shake roofs and misguided fiery missles?

    Talk about “In A Blaze Of Glory”!

    One things is for sure – The MCSD probably gets a measureable level of toxins in the drainage system that sit until the next rainy season, or fire-hydrant test, or the typical summer rain, car wash water, etc….

    Mr. kirk, with all due respect, people who are put in sensitive positions of public trust SHOULD be held to a hire standard than the general citizenry.
    Often a judge and prosecutor will (successfully) argue that “ignorance of the law is no defense” when Joe or Jane Ordinary is in court.Being in a position to enforce such laws and then picking and choosing which to obey isn’t simply a matter of setting a bad example,it’s an indication of sociopathology.

    No, I don’t believe in “triple penalties” but abuse of authority or violation of the public trust should negate plea bargains and lighter sentences for fear that such violators can’t be safely guarded in general population jails and prisons.

    I believe that this should be true of ALL elected officials, CEO’s of publicly traded corporations,military personnel and other public servants.

    Just my opinion, Mr Kirk.

    Crack whore leaves drugs where a kid can get to them and
    the right would say to hang her by her thumbs, but when the DA says
    this deputy will be charged just like anyone else who broke the
    same laws they say he’s picking on law enforcement. It’s just
    possible that the DA is the one person not taking politics into
    consideration when he makes his decisions.

    Possible 9 years for fireworks?… compare to 11 years

    for stabbing a woman multiple times, killing her and

    throwing her body off a bridge.

    Not sure what the fireworks stupidity should get but I’d like the murder sentence to be more, please.

    First of all, let me just say that I think the killer who got the 11-year sentence deserved a longer sentence for his crime.

    But you’re comparing the 11-year sentence that the Klamath killer actually got with the theoretical 9-year sentence that cop with the illegal fireworks that seriously injured a small girl could potentially get. When all is said and done, I seriously doubt the cpp will get anywhere near the maximum sentence, probably more like a relatively short term behind bars, followed by some years of probation.

    It’s also worth noting that according to the T-S story about the Klamath case, one of the reasons the DA in Del Norte (note: different county, different DA) agreed to the plea bargain deal with its 11 year sentence is that their case was apparently “light on physical evidence and witnesses” meaning that there was at least SOME risk that if they had gone to trial they MIGHT have failed to obtain a conviction.

    So, while I think the guy deserves more than 11 years for killing his victim, I don’t necessarily blame the DA up there in Del Norte for not obtaining a longer sentence…the DA has to play the hand they are dealt, and in some cases the risk that the defendant could be aquitted at trial (and therefore get away scot-free) outweighs the injustice created by a shorter-than-ideal sentence obtained by plea bargain.

    If threatening this guy with harsher than normal punishment would actually stop children from having their fingers blown off, why wouldn’t threatening harsher punishment against all law-breakers stop all crime?

    Mandatory death penalty for all felonies? Why stop there? Why not call for mandatory death penalties for all misdemeanors, too?

    This is just a very sad story all the way around. The officer should have known better. The parents should be ashamed of their actions also, I don’t know how they will ever forgive themselves. This poor little girl will never be the same. This kind of thing happens every year, I just wish people would learn! Some holiday traditions just need to go away!

    He was charged with Felony Child Endangerment, which seems to me like exactly what he should be charged with. He obtained illegal fireworks, and gave one to a young girl to set off, resulting in serious permanent injury to the girl. I mean, what do you think he should be charged with? Disturbing the Peace? Disorderly Conduct? Face it, he broke several laws and in so doing he caused serious permanent harm to a child.

    If 9 years is the maximum sentence for that charge, that’s just the way it is. Most likely he won’t get anything like the maximum, because (sadly) this incident is nowhere near the most extreme case of child endangerment that the courts have to deal with.

    For those who think that he shouldn’t have been charged at all, or should only have been charged with a misdemeanor, because he didn’t intend to injure the victim, I would ask you whether instead of a cop providing an illegal firework to a child, resultng in permanent injury (“accidentally”), what would you say if it was a drug abuser who provided drugs to a child, resulting in a serious permanent injury (“accidentally”)? Would you still be so quick to want to let the perp off the hook just because they didn’t intend for the child to be harmed?

    This cop should be held to the same standard as anyone else, which in this case means being charged with Felony Child Endangerment.

    He made a stupid, stupid mistake. But sending him to prison with murderers, robbers & rapists and destroying his life ? He deserves to be punished but he did not mean to hurt the girl.

    Nine years but the guy who did murder that girl from Crescent City was given only 11 years in his sentencing last week ? Another murderer last week, was given 12 years. We need to keep things in perspective please.

    I agree about perspective but the father who was also present and knowingly allowed illegal fireworks around his kid should also be held culpable. Child endangerment goes to the parents as well as the guy who has to live without his fingers- a daily reminder Plus probation plus one can assume the loss of his employment. He has suffered enough in my Opinion.
