Democracy Now! asks Who Bombed Judi Bari

Southern Humboldt Earth First! activist Darryl Cherney was on Democracy Now! this morning to talk about the new documentary Who Bombed Judi Bari.

    Actually, the bomber may be feeling rather nervous at the moment. Darryl and his lawyers will be in court in April, where a judge will decide if an identical bomb — which was planted, but failed to go off, at the LP mill in Cloverdale, just two weeks before the Bari bombing — will be turned over to an independent forensic investigator to look for clues including fingerprints, hair, DNA, etc., which can then be compared against those of potential suspects, as well as with fingerprint and DNA databases.

    The FBI, which never did much investigating once its initial attempt to frame Bari and Cherney had failed so spectacularly and completely, is of course fighting once again to withhold the evidence, thereby continuing to protect the bomber, just as they have for all these years.

    Bruce Anderson has a pet theory, a folksy writing style, and a plethora of seething grudges and personal hatreds…and that’s about it.

    Among his absurd assertions is that Bari and Cherney were/are part of a cover-up, protecing the real bomber. Which doesn’t exactly square with Cherney repeatedly going to court to preserve the evidence and to have it tested for fingerprints and DNA. But since that inconvenient fact doesn’t square with Anderson’s pet theory, he simply ignores the contradiction.

    Anderson may be “knowledgeable” about the case, but unfortunately his extreme bias clouds his ability to put that knowledge into any kind of rational framework. It’s actually kind of sad. But it’s hard to feel sorry for him as he slanders a dead woman who was an innocent victim of a terrorist attack.

    I read numerous stories in the AVA where Bruce Anderson point blank names the person he considers to be the culprit, and why.
    He points out, accurately, that if these printed declarations were not true – libelous – the accused person could easily sue Anderson for big bucks, and even put the newspaper out of business. However, to do this, the accused person would have to testify under oath, and apparently he does not want to be in that chair. It begs the question as to why that libel suit was never filed, if Anderson’s claims are inaccurate..Just sayin.

    For all I know, the person Anderson accuses might be guilty…but Anderson certainly hasn’t presented anything even approaching any hard evidence for that.

    And it may well be that the person Anderson is accusing is entirely innocent, and just doesn’t want to give the rantings of someone like Anderson any credence. I suspect that’s how I’d feel about it if I were that person.

    By the way, that comment thread includes some direct point-counterpoint between Bruce Anderson and Darryl Cherney. Makes for interesting reading. In my view, Cherney demolishes most of Anderson’s accusations. But I don’t deny that I came into that discussion with my own pre-existing bias, due to the fact that I had already found Anderson rather non-credible, based on his creative but highly speculative ramblings about this issue in the various articles available in the archives of the AVA.

    Cherney should take a lie detector test about the incident before anyone should believe him. Also, so should the Unibomber who was known to be in the same general area when he was in the Bay Area. Unwanted competition by EF! for anti-corporate activist revolutionaries may be a motivation. In any event, key people like Cherney should clear the air about their involvement by taking lie detector tests.

    I sat next to Judi at a lunch counter in Garberville many years ago, and ate my lunch. We did not speak. She was going through her 3-ring binder, and talking to the waitress talking about the stuff in her binder. She seemed like a nice person, but I thought she was a “nut”.

    My perspective has since changed. I wish I had spoken to her.

    Daryl laughed all the way to the bank with millions is loot from the payoff. He put it into his dope empire in SoHum. The film is pure propaganda. He’s hoping to hose a few suckers for some more “donations.”

    You’re delusional HN. Even the FBI and the OPD soon gave up on the theory that “she bombed herself,” given the design of the bomb.

    The bomb had an on-off switch, a timer, and a ball-bearing activated motion detector. The bomber placed the bomb under Judi’s seat, switched it on, and set the timer, and then when Bari and Cherney got in the car and drove off the motion detector kicked in, activating the timer, and a few minutes later it blew up. So it was clearly deliberately designed and activated in such a manner as to kill the driver, which it nearly did.

    Thank you Outlaw1 for the poignant reminders of all the machinery that suffered under the tyranny of EF, despite the best efforts of every sheriff’s deputy in Humboldt County to stop the protests.

    The Earth provides broad evidence that It’s the natural order of nature for human beings to mine as much resources as possible regardless of silly political issues over depletion, pollution and extinction.

    Why do the environmentalists hate the natural order of things so much?

    tra, thanks for reminding us of the party line version of the Bari bombing. As you know, neither the FBI nor the OPD ever came close to endorsing your attempt at propaganda.

    Bari’s smirking threats to bomb PL and other timber interests were part of the EF repertoire. She was transporting one of her bombs when it blew up.

    Daryl squeezed a million bucks out of that bungle. How much is it going to cost the taxpayers this time?

    You sure are misinformed. The info on the design of the bomb is from FBI’s own analysis, and is what caused the FBI to quickly give up on their initial “they bombed themselves” theory. This is all documented in court. The judge and jury in the federal civil rights trial heard 6 weeks of testimony, including plenty on the design of the bomb, which was without question designed and activated in such as way as to kill the occupants of that vehicle.

    As far as your claim about “Judi’s smirking threats to bomb PL…” all I can say is that you must have been hallucinating. Judi was a staunch advocate of non-violence, as well as a labor organizer who was completely opposed to even insulting timber workers, much less harming them. She was a fierce critic of other Earth First figures, like Dave Foreman, who advocated tactics like tree-spiking.

    Basically you’re dead wrong about the facts about the bomb, as well as dead wrong Bari herself. And unlike your nonfactual claims, the actual facts about the bomb are well-documented in the court records, and the actual facts about Bari’s position on nonviolence and her attitude toward the timber workers are well documented in her own writings and speeches.

    So if you would like to learn the truth about either of those matters, there is no question that you could do so. The question is do you want to learn the truth, or would you prefer to continue to wallow in your ignorance so that you can continue to make your nonfactual claims? Based on your comments thus far, my money’s on the latter.

    Judi Bari posed for photographs with a machine gun and a smirk. The “non-violent” act was a useful pose while she and EF spiked trees and destroyed logging equipment. How many times were we assured that she was going to shut down PL “by any means necessary?” In fact, Judi, Daryl and the EF thugs brought our timber industry to its knees. And in its place they gave us hard drugs and misery.

    You’re either very gullible or working with Daryl. Based on your comments thus far, my money’s on the latter.

    Actually, us humans still have a shot at it. In just a few weeks, the federal judge who presided over Bari and Cherney’s successful federal civil rights lawsuit, will be ruling on whether the Cloverdale bomb will be turned over to independent experts to be examined for fingerprint, DNA, and other forensic evidence, which can then be compared to the fingerprints, DNA, etc., of potential suspects. So it’s still possible that we may get to the bottom of this yet.

    To those poor misinformed individuals who still want to believe that Bari and Cherney had anything to do with the bombing, or had any role in covering up for whoever the real bomber is, I’d love to see you try to explain why it was Bari and Cherney’s lawsuit that demanded that a full investigation be conducted, and then, failing that, demanded (and won) the right to preserve the evidence and to have it examined by independent experts — while it has been the FBI that long ago abandoned any attempt to investigate this terrorist act, actively fought in court to be allowed to destroy the evidence, and even all these years later, is still trying so desperately to prevent a forensic examination of the Cloverdale bomb.

    Maybe because if they couldn’t officially pin the blame on Judi and Darryl, they preferred not to find the real culprit, because that way poorly-informed and extremely biased individuals like Humboldt Native could continue slandering the victims of this domestic terrorist attack by pretending that there was any reason to believe that they were the perpetrators.

    Or maybe there just wasn’t enough solid evidence pointing towards Sweeney to justify considering him an actual suspect. Or maybe some of both.

    At any rate, it’s a good question…to ask the FBI and OPD.

    Meanwhile those who remain so desperate to pin the blame on Judi and Darryl seem (unsurprisingly) unable to explain why Judi and Darryl fought so hard, (and Darryl continues to fight) to preserve evidence and have it tested for fingerprints and DNA and other forensic clues. If they were guilty, or shielding someone who was, that would be the last thing they would have wanted. The theory that Judi and/or Darryl were somehow responsible for the bomb, or knew who was and were covering up for that person, just doesn’t fit with the facts. So the haters just ignore the facts while repeating their groundless, long-debunked accusations. Truly pathetic.

    Mighty brave of you to post that link to the LCO thread, tra. That thread refutes your claim that Bari protecting the real bomber is some invention of Bruce Anderson. You tried to keep your story going by defaming Stephen Talbot, even when other independent investigators (not Anderson) corroborate what was reported by Talbot. I know you don’t like being confronted with evidence of Bari’s less than sterling character and her defamation of one particular individual to prop up her martyr myth, but you can’t answer it by smearing investigators who had no vested interest, started out sympathetic to Bari, and found evidence of her guilty knowledge in the case.

    jr: I have no idea who wrote the “Lord’s Avenger” letter. But when accusations are introduced under the vague heading of “I have heard that…” this does not lend much credibility to the claim. Heard from where, based on what?

    According to Darryl (commenting on the Lost Coast Outpost thread that I linked to above) the “Lord’s Avenger” letter was examined for forensic evidence, yielding DNA from an unknown female. One of the reasons that Darryl is trying to get the Cloverdale bomb tested for forensic evidence is to see if they find a match for other DNA collected in the case, including the DNA that was found on the LA letter, which could establish that whoever wrote the LA letter also handled the Cloverdale bomb.

    The Cloverdale bomb is a bomb that appears very likely to have been made by the same person that made the bomb that went off in Judi’s car. But the Cloverdale bomb failed to explode, and it has lots of duct tape on it — meaning a good chance of finding fingerprints, hair, and DNA.

    While you’re asking the FBI why they didn’t consider Bari’s ex as a suspect, perhaps you could also ask them why they have fought tooth and nail to be allowed to destroy various pieces of evidence without doing this kind of forensic examination and testing, and why they are still fighting in court to try to prevent the Cloverdale bomb from being tested so that DNA from that can be compared to the DNA of various suspects, as well as DNA found on other evidence, including the Lord’s Avenger letter. Good luck getting a straight answer on that.

You make a strong point about the FBI wanting to destroy evidence, considering that the case has not be solved. What did the FBI or Oakland PD have to gain from stonewalling? It would be good to see the recent film followed by Steve Talbot’s film and compare notes on each one.

    EF played both sides of the fence on tree spiking. The official line was against it by 1990, but there were still some enthusiastic advocates. One such enthusiast, who in 1990 decided I looked like someone he could talk to about such things, is on video locked down at CalTrans during a Richardson Grove protest.

    There’s 4 percent of the 2-million-acre old-growth redwood ecosystem left.

    That is, timber companies cut 1,920,000 acres.

    And now there are 80,000 acres left.

    Yet it’s environmentalists who killed the timber industry? Only an idiot would believe this.

    Overcutting and mill mechanization. That’s what did it. If none of those 80,000 acres had been saved they would all be gone by now and the timber industry would be exactly the same as it is today, only some fat cats would be that much richer.

    Now, to the question of who bombed Judi Bari: Even if you didn’t like her or her politics, why would you doubt that someone would want to kill her?

    Twelve jurors decided in one hour that the FBI had framed her, but they took a couple of weeks to decide how much to charge them for the federal government’s framing of her and Judi. That was the deliberation, that’s what took so long: 1 million or 4 million or 10 million?

    The evidence was so clear: that Judi was a victim not a bomber, and the the FBI and Oakland police had framed her (and, of course, had probably bombed her). It was pretty basic once you looked at the facts (which several posters here refuse to do).

    So those spikes that ripped blades off the Head Rig at Eel River Sawmills in the 90’s were from the loggers themselves, trying to frame the protestors. Have any of you worked around a Head Rig when a log passes thru that was spiked and have pieces of the sawblade flying around; or the few Off-Bearers who on numerous occassions, barely got out of the way of a broken blade from a tree spike. It happened in Humboldt all the time. I was one of those workers under or around the Head Rig when this happened.
