Dems contact AG over Arkley shove

The Humboldt County Democratic Central Committee approved the below letter to CA Attorney General Jerry Brown regarding last week’s shoving incident against Eureka City Councilman Larry Glass.

Dear Attorney General Brown,

A violation of the California Penal Code Sections 71 and 85 was reported by a Eureka city council member to have occurred in Humboldt County last week, and we are requesting your office take the lead in the investigation and prosecution of this alleged violation. According to Eureka City Council member Larry Glass the violation took place in front of several witnesses, none of whom have come forward for the media, but who we believe would testify truthfully to law enforcement officials.

Due to political conflicts, Humboldt County District Attorney Paul Gallegos will no doubt want to recuse his office from prosecuting the matter. The Humboldt Democratic Central Committee believes any reported attempt to influence public policy through violent acts and threats of personal destruction must be pursued by legal authorities.

According to Glass, he attended a Chamber of Commerce reception for the state Coastal Commission last week, at which he was repeatedly shoved and threatened by Robin P. Arkley II, a local businessperson; Glass reports Arkley made several statements to the effect that he would “destroy” Councilman Glass if the councilman failed to support Arkley’s controversial Eureka waterfront development proposal.

Egregious violations of those laws protecting public officials must be pursued, and we look to you to pursue this case in light of the political conflicts surrounding the incident. We look forward to hearing from you or your representative. Contact information regarding this incident follows:

    Yes, please help us, because we can’t help ourselves. Only the great big benevolent eye in Sacramento can bring some resolution to our big, huge problem that has split families apart and shattered little girls’ dreams.

    Dear God, help us. Our community will not be able to move forward until this is resolved at a legal, Sacramento-legal leval. Please.

    According to the guy who is claiming that it was a VERY big deal, nobody else is stepping forward to confirm his story. In highschool, which is when this sort of thing last rared its ugly head, we just discounted the whole thing because it was just this…one guy making a big deal about a non-issue that nobody but the original ‘claimant’ to complain about. Boring.

    Yes, we, as the populace who have a VERY good handle on this situation here have determined what the DA should and shouldn’t do based on politics. That is why we have taken it upon ourselves to speculate on what the top law enforcement official from the county will do. As the official committee on what the DA should do, we demand that you take us more seriously than any other quack group randomly emailing your office. Please? Hello?

    Put aside for a moment that these are allegations, dear AG, and just ASSUME that an agregious violation of the law occured, because, really, it did. People are guilty until proven innocent, remember? THAT IS WHAT IS IMPORTANt. What happens in the public court is FAR more important than the court of law. I, and a few other bitter left-leaning folk agree, SOMETHING agregious has occurred. You have to take my word for it. IT HAPPENED. Really, it wasn’t a blow hard blowing off steam to a businessman who happened to give away and sell at no profit stickers and T-shirts that mocked another guy’s family. No biggie. Really, there are examples of this sort of thing all over the place. It is so common, it boggles the mind.

    By repeating what has been stated over and over, I grow more confident that I know what really happened. Really. I am convinced. In fact, after Larry’s 5th and 7th calls last night, I almost feel good about this whole thing.

    Dear Attorney General Pigpen,

    A violation of the Cartoon Penal Code Sections 92, 47, and 82 Hut Hut Hike was reported by myself last week and I am requesting your office take the lead in the investigation and prosecution of this alleged violation. This violation took place in front of my entire football team, the opposing players and fans in attendance, all of whom laughed at me, but I believe would testify truthfully to law enforcement officials.

    Due to political conflicts, Linus Van Pelt will want to recuse himself from prosecuting the matter due his familial relationship with the accused. I believe this attempt to influence a game’s outcome through violent acts and unkept promises of personal destruction must be pursued by legal authorities.

    I attended and performed the role of quarterback at a football game for neighborhood kids last week, at which I was repeatedly told by Lucy Van Pelt, “I’ll hold the football like this, and you come running up and kick it.” Lucy Van Pelt repeatedly pulled the football from my kicking zone just as I would run up and kick it, thus sending me into the air and yell “AAAAAUUUUUUUGH!” as I fell on my back with a large “WHUMP!” sound. Good grief!

    Seems to me I saw Cherie a few days ago in her car at the intersection of I and Buhne Streets in Eureka. Could have been more than just a few days ago, though.

    Interesting how the same folks that so vociferously supported the incompentent defense attorney for the position of District Attorney are so quick to dismiss him. Or is it just that their hatred of Arkley is so intense, and their sense of self-importance so great, that they feel it necessary to knock on the AG’s door with this?

    Okay- sorry! You have a right to discuss what you want. I think blogs are fun! And “boy”, I check in to get info just like you. I just think blog creators as well as some who seem to get stuck with one topic have some serious obsessive issues. Like, who would create an entire blogsite called “arkleywatch”- really, it shows a lack of having substance in their own life. Okay, off my pedestal, blogs are usually fun and informative! Yet, they can be petty and cruel due to the anonymity and freedom that brings (back on the pedestal). Most of the people I see written about (both sides!) have good qualities that are somewhat misunderstood by their adversaries.

    So Blank thinks that it’s no big deal if a guy who is know to hire private eyes to follow people he is out to get, and is know to have bought property just so he can evict a tenant he has a beef with, that it is no big deal if this guy swears to an elected official that he will “destroy you and destroy your business”, if he does not vote a certain way?
    Yea, well, all that is at stake is our democracy, so lets not pay that much attention.

    I think some of it is only in the minds of people with good imaginations, some is exaggerated, and I also acknowledge that some could be true. I just don’t like the “auto-spin” by certain types the minute they hear a rumor- the reputation of this person has taken on a life of its own. If all of it is true, then yes, it is a big deal.

    Democracy also allows for a person to be innocent until convicted.

    If you don’t think a two-handed shove constitutes an “attack,” perhaps you’ll enjoy this hysterical Eureka Reporter article that used the same term to described a poster that called Cheri Arkley a liar for her “read my lips, it won’t be a big box” comment.

    People passing by Domino’s Pizza at the corner of Fifth and F streets in Eureka on Monday morning were greeted with an attack on Security National’s co-owner Cherie Arkley.

    The homemade poster had been affixed to the side of a Eureka recycling bin.

    A large red exclamation of “LIAR!” had been placed on a photograph of Arkley. The poster creator had also drawn a quote balloon in front of Arkley’s mouth, which contained a reference to a 2004 statement to media about plans for the Eureka Rail Yard, or “Balloon Track.”

    Funny how taking note of Arkley’s broken promises are considered an “attack” but an assault by Rob Arkley should be virtually ignored.

    Arkleyville, indeed.

    When you are being menaced, the intelligent thing to do, if you can do it, is to de-escalate the situation. Then, when the danger is past, report it to the police if it was serious enough for that.

    Meeting force with force can result in serious injury or death. Don’t forget the two men outside Denny’s in Eureka several years ago. They got into an argument and decided to finish it by fighting. One of the men landed a single blow that knocked the other man down. As he fell, his head hit the sidewalk, killing him. The man who struck that blow thought that dropping the other guy was the answer to his problems. He didn’t expect his violence to lead to his own stay in prison. He probably never gave much thought to the effect of living the rest of his life knowing he had unnecessarily killed another human being.

    In my understanding according to the law Assault happens when someone physically menaces someoneThere does not have to be actual physical contact to commit assault ,

    Assault and Battery happens when a person makes physical contact.

    At the very least, it would seem, that Arkely is guilty of assault. No one denies that he got in Glass face.

    The question really is weather Ark committed assault AND battery.

    Those people who say Glass should have fought back are crazy, If you commit an illegal act in response to someone else’s illegal act then you are being very stupid.

    Glass said Arkley was standing across the table from him pointing and smiling, when he said something Glass couldn’t understand. So Glass walked around the table to talk to Arkley.
